Today in History: The U.S. Supreme Court Upholds the Partial Birth Abortion Ban

04/18/10

On April 18, 2007, the U.S. Supreme Court upheld the constitutionality of the Partial-Birth Abortion Ban Act with its 5-4 ruling in the case of Gonzales v. Carhart. The Act, which was signed into law by President George W. Bush in 2003, prohibited the use of a late-term abortion method formally known as intact dilation and extraction. Many observers viewed the decision as an indication that the Roberts Court would be likely to approve future restrictions on abortion.
